2. Petitioner is retired Class-III employee. He seeks applicability of Roop Lal versus State of H.P and others2 as affirmed by Hon’ble Apex Court in State of H.P and others versus Roop Lal3 to earn pension. 2 from the case record that respondents had previously rejected petitioner’s case seeking applicability of Sunder Singh versus The State of Himachal Pradesh & Others,4 Balo Devi & Others versus State of Himachal Pradesh and others5 and Roop Lal2 under order dated 06.06.2024 on the ground that SLP No.1007/2024 was pending adjudication before the Hon’ble Apex Court on that stage. The said petition, as noticed above, stands decided and consequently, Roop Lal2 has been affirmed. Hence, this writ petition is disposed of with direction to respondent No.2/Competent Authority to consider and decide the case of the petitioner afresh for applying Sunder Singh4, Balo Devi5 and Roop Lal2 after examining the facts of this case in accordance with law. Fresh consideration order be passed within a period of four weeks from today. The decision so arrived at shall also be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
