Heard Sri. A.C. Balaraj, learned counsel appearing for the petitioners and Smt. Navya Shekar, - 4 - HC-KAR NC: 2025:KHC:22040 WP No. 20322 of 2024 learned Additional Government Advocate appearing for the respondent-State. 3. Having taken note of the submission made by the learned counsel appearing for the petitioners and learned Additional Government Advocate, the respondent No.2, while passing the order dated 16.12.2022, rejected the claim made by the petitioners herein on the sole ground that the petitioners have not provided the correct survey numbers of the land in question in the Revision Petition. 4. In that view of the matter, taking into consideration the fact that, as the rights of parties are involved with regard to the land in question, I am of the opinion that, it is fit case to remand the matter to respondent No.2 to consider the issue afresh after - 5 - HC-KAR NC: 2025:KHC:22040 WP No. 20322 of 2024 affording an opportunity to the petitioners and other parties concerned. In the result, I pass the following: ORDER i) The writ petition is allowed; ii) Order dated 16.12.2022 in R.P.No.540 of 2021-22 (Annexure-K) passed by the respondent No.2 is hereby set aside and the matter is remanded to the respondent No.2 to consider the matter afresh, after affording an opportunity of hearing to all the parties concerned. iii) It is also open for the petitioners and the respondents to file necessary documents before the respondent No.2 to enable the respondent No.2 to take decision in the matter. - 6 - HC-KAR NC: 2025:KHC:22040 WP No. 20322 of 2024 iv) It is also open for the petitioners to amend the Revision Petition by incorporating the correct details of the suit schedule properties, including accurate survey numbers.
