1. This is first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No.19/2025 registered at Police Station Arang, District Raipur (C.G) for the offences under Sections 103(1) and 238 of BNS, 2023.

The prosecution story, in brief, is that on the basis of information given by the brother of deceased on 07.01.2025 that her sister has died in suspicious circumstances, the Police have registered the Merg and commenced the inquest proceedings. After conducting the postmortem of the deceased, the cause of death of the deceased was found to be asphyxia due to strangulation. During the inquest, it was revealed that the applicant used to suspect the fidelity of his wife, beat her and killed her and without informing to any-one, A ANNAJEE RAO Digitally signed by A ANNAJEE RAO Date: 2025.07.23 16:17:15 +0530
2 he had gone to consign the body to flames, which the Police have stopped.

Learned counsel for the applicant submits that the marriage of the applicant and deceased-wife was performed 15 years back and he has not committed any offence as projected by the prosecution. He submits that the wife had committed suicide by hanging and on suspicion, the applicant was arrested. He further submits that there is no evidence against him to connect him with the crime in question and only a rope was seized from him. He submits that the applicant is in jail since 12.01.2025 and there is no immediate possibility of disposal of the case, therefore, he may be enlarged on bail.
4. Per contra, learned State Counsel opposes the bail application and submits that as per the postmortem report, the death of deceased was homicidal in nature and not suicidal. He submits that the deceased was killed by the applicant by strangulation and without any informing to anybody, he had gone to conduct her funerals, which was prevented by the police.
5. Having considered the submissions made by learned counsel for the parties and the facts and circumstances of the case, I am not inclined to release him on regular bail at this stage. Accordingly, the bail application is rejected.
6. A copy of this order be sent to the trial Court for information. Sd/-
