Sections 80(2) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (for brevity BNS). 2. The case of the prosecution is that the incident occurred prior to 26.06.2025 at 12.00 hrs at the house of Kothapalli Chiranjeevi and reported on 03.07.2025 at 17.00 hrs, wherein the defacto complainant stated that her parents Nakka Pothuraju and his family members performed the marriage of her sister with Kothapalli Chieranjeevi as per Hindu customs on 09.11.2018.
Later the husband of her sister by name Chiranjeevi began consuming alcohol daily and harassed the sister of the defacto complainant for dowry. On 26.06.2025 around 12 noon, the sister of the defacto complainant received a phone call from her brother-in-law that her sister was seriously unwell and undergoing treat at Visakhapatnam KGH Hospital. When they asked Chiranjeevi, he informed that her sister hanged herself in the house. They found severe injuries below the knees and around the neck. There were marks on her neck that appeared to be caused by strangulation with a rope. There was also excessive bleeding from the vaginal area. During undergoing treatment, she was declared as dead. Hence the crime was registered. 3. Mr. Khaja Khutubuddin Shaik, learned counsel for the Petitioner, submits that the Petitioner has not committed any offence, he was falsely implicated in the case; he is the sole bread-winner of his family; he is ready to abide by any conditions imposed by this Court and urged to enlarge the Petitioners on bail. 4. Per contra, Ms. P. Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed to grant bail to the Petitioner, submits that the investigation is still in progress and several material witnesses were remain to be examined. It is contended that if the Petitioner is released on bail at this stage, there is strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing submissions, it is urged to dismiss the Petition. 5. Heard leaned counsel for the Petitioner and learned Assistant Public Prosecutor. Perused the record. 6. The Petitioner/ Accused No. 2 is the mother-in-law of the deceased. The Petitioner was arrested on 05.07.2025 and she has been in judicial custody for the past 54 days. In the Postmortem Report, it was noticed that there are external wounds and also strangulation marks. It was also noticed that blood was oozing from vaginal area of the deceased.
Only 14 witnesses have been examined and investigation is at progressive stage and some more material witnesses have been examined. In view of nascent stage of investigation, this Court is not inclined to grant bail to the Petitioner at this juncture. Hence, the Criminal Petition is liable to be dismissed for the present. 7.
