1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.132/2025 registered at Police Station – Darri Korba, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.07.04 16:28:47 +0530

2. Case of the prosecution, in brief, is that prosecutrix aged about 30 years working as nurse in N.K.H. Jeevan Asha Hospital Jamnipali whereas the applicant is also working in the same hospital both have them fall in love, the prosecutrix on 21.05.2024 made complaint against the applicant that she is working in the Jeevan Asha Hospital Jamnipali as a staff nurse whereas the Rohit Sahu (applicant) is also working in there, in pretext of marriage he has developed the relationship with the prosecutrix and since last five years they are in relationship, by changing the places they developed the physical relation when the prosecutrix asked to performe marriage to the applicant he has given excuses. She further alleged that Rohit Sahu has captured some photograph by which he is black mailing her to viral it, she further alleged that the Rohit Sahu is already married and having children he stated that he will get divorce from his wife and perform marriage with her, when the applicant blocked the mobile number of the prosecutrix she approached his house whereas her relatives thrown her from the house, thereafter she made written complaint to the police of police station Urga after registration of FIR in zero same was forwarded to the concerned police station i.e. Police Station Darri Korba. The applicant applied for anticipatory bail before the court below same was rejected. Hence this anticipatory bail application.

Learned counsel for the applicant submits that the applicant is innocent and falsely implicated in this crime. He would submit that the prosecutrix is aged about 30 years and she is having illicit relationship with the applicant more than five years she is major. He would submit that applicant and prosecutrix both are working in the same hospital i.e. N.K.H. Jeevan Asha Hospital Jamnipali District Korba they known each other for several years. He would submit that the prosecutrix is already married lady, suppressing this fact she entered with the love relationship with the applicant. Therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, also perused the statement of the victim under Section 183 BNS, considering the fact that the victim is a major lady, she came in contact with the applicant in 2019 and for the first time in 2021 they developed physical relationship and FIR has been lodged in 2025 and also considering the fact that investigation and trial are likely to take time, therefore, I am inclined to grant anticipatory bail to the present applicant. 4

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Rohit Kumar Sahu, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
(e) The applicant shall not involve himself in any offence of similar nature in future. Sd/- (Ramesh Sinha)
