GP FOR SERVICES I The Court made the following: THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.22033 OF 2025 ORDER:- The present writ petition is filed questioning the charge memorandum issued to the Petitioner on 16.04.2025 by Respondent No.2 under Rule 20 of A.P.C.S.(CC&A) Rules, as illegal and arbitrary. 2. As per the articles of charge, the charge against the Petitioner is that he has conducted misconduct while invigilating the MBBS Examination at Siddhartha Medical College on 07.04.2025. It is stated that the Petitioner given a representation explaining that he is not an invigilator on the day and that the charge memorandum has a mistaken identity. 3. Learned counsel for the Petitioner would submit that as promotions to the post of MSW Grade-I are being considered, the present writ petition is filed for a direction to consider the case of the Petitioner for promotion to the said post without reference to the impugned charge memorandum. 4. At the time of hearing, learned counsel for the Petitioner pass on a letter vide Rc.No.3510/E4/2025, dated 19.08.2025 forwarded by Respondent No.4 the representation/appeal of the Petitioner to Regional Director of Medical and Health Services-Respondent No.3. It is stated that if the representation of the Petitioner is considered before effecting the promotions, the charge memorandum would be dropped as the same was issued under mistakenly identity. 5. Considering the same, Respondent No.3 is directed to consider the representation/appeal of the Petitioner forwarded by Respondent No.4 vide letter in Rc.No.3510/E4/2025, dated 19.08.2025 as expeditiously as possible. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
