ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“...to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the order in the form of notice in Roc.No.4/2024, dated 02.01.2025 issued by the 4 respondent thereby directing demolition and eviction of petitioners from their respective houses and site properties situated in an extent of Ac.2.00 cents, situated in R.S.No.158 & 159 of Narayanapuram Village, Unguturu Mandal of Eluru District (formerly known as West Godavari District), as illegal, irregular, irrational, without any authority of law, violative of principles of natural justice and offends Article 14, 21 and 300-A of Constitution of India and consequently direct the respondents not to interfere in any manner with petitioner’s said respective house and site properties and pass such other order or orders... ” th
2. Heard learned counsel for the petitioners and learned counsel appearing for the respondents.
3. The writ petitioners herein assailed the show cause notice, dated 02.01.2025 issued by the 4"^ respondent/Panchayat Secretary of Narayanapuram Gram Panchayat, Unguturu Mandal. On examining the notice dated 02.01.2005 a final directive was issued to the petitioners to remove the encroachments within seven (7) days from the date of receipt of the impugned notice. The said impugned notice was issued on the direction of this Court in W.P. No.30888 of 2024. This Court specifically posed a question about the maintainability of _
3 the writ petition as the impugned notice was issued as directed by this Court. There is no answer from the learned counsel for the petitioners. However, the petitioners are being landless poor persons, this Court is essentially directs the petitioners herein to submit an explanation for the notice issued vide R.O.C.No.04/2024 dated 02.01.2025 by the 4**" respondent within a period of two weeks from the date of receipt of a copy of this order and on receipt of such explanation by the petitioners, the 4**^ respondent/Panchayat secretary is hereby directed to examine the same and pass appropriate orders in accordance with law. Till such time, the respondents are hereby
directed not to take any coercive steps against the petitioners.

5. Accordingly, the Writ Petition is disposed of. There shall be no
order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
