1. The petitioner has filed this petition challenging therein the communication dated 01.06.2018 issued by the Registrar Cooperative Society, CG whereby the matter with regard to the seniority of the petitioner has been referred to the Secretary Cooperative Department, Raipur. 2. The facts of the present case are that the petitioner was promoted to the post of Assistant Grade -I, but his name in the seniority was not Digitally signed by RAMESH KUMAR VATTI
2 placed in an appropriate position. The petitioner made a representation dated 27.01.2015 followed by reminders, but no decision has been taken. Thereafter, he filed WPS No. 3093/2017 wherein a direction was issued to respondent No.2 to take an appropriate decision on the representation of the petitioner at the earliest preferably within 60 days. Thereafter, when no action was taken, the petitioner again made a representation dated 16.10.2017 before Respondent No. 2 who vide communication dated 01.06.2018 intimated to him that the matter has been referred to the Secretary Cooperative Department, Raipur seeking further instruction. Therefore, the petitioner has filed the instant petition seeking direction to respondent No. 1 to decide the matter. 3. Ms. Harneet Kaur, learned counsel for the petitioner would submit that pursuant to the order passed in WPS No. 3093 of 2017, a representation was made before the Registrar Cooperative Societies and the same has been disposed of vide order dated 01.06.2018. She would submit that the Registrar Cooperative Societies instead of taking a decision on the representation of the petitioner referred the matter to the Secretary, Cooperative Department, Raipur (CG) seeking therein instructions.
She would contend that a direction may be issued to the State Government and Registrar Cooperative Societies to decide the pending representation moved by the petitioner expeditiously. 4. On the other hand, Mr. Prateek Tiwari, learned Panel Lawyer appearing for the respondent would oppose. 5. Taking into consideration the limited prayer made by Ms. Harneet Kaur, this petition is disposed of with a direction to respondents No. 1 and 2 to take appropriate action on the representation of the petitioner keeping in mind the letter dated 01.06.2018 issued by the Registrar
3 Cooperative Societies to the Secretary Cooperative Department, Raipur. 6. It is expected that the authority concerned shall take a decision expeditiously preferably within a period of 150 days from today. 7. With the aforesaid direction(s), the petition is disposed of. Sd/-
