Learned counsel appearing on behalf of the petitioner seeks permission to withdraw the application filed before the trial Court under
Order 7 Rule 14 read with Section 151 of Civil Procedure Code, which was disposed of vide impugned order dated 30.05.2023, wherefrom the present petition has arisen, with liberty to file a fresh application with better particulars.
2. Permission allowed. Accordingly, the petitioner is permitted to withdraw the application filed before the trial Court under Order 7 Rule 14 read with Section 151 of Civil Procedure Code, which was disposed of vide impugned order dated 30.05.2023, wherefrom the present petition has arisen, with liberty to file a fresh application with better particulars. 1 Whether reporters of Local Papers may be allowed to see the judgment?

3. In view of withdrawal of the aforesaid application, the present petition stands disposed of, as the impugned order does not survive, so also, pending miscellaneous application(s), if any. However, the time spent in pursuing the present petition before this Court against the impugned order dated 30.05.2023 shall not be taken into account while dealing with the fresh application so filed.
4. The parties are directed to appear before the trial Court on
27.11.2025. Fresh application qua which liberty has been sought be filed within two weeks of putting in appearance before the trial Court on
27.11.2025. No further time for doing the same shall be granted.
