ORAL JUDGMENT
No representation for the appellant.
2. This matter is registered as criminal appeal though if is styled as memorandum of application under Section 439 of Criminal Procedure Code, 1973. Even prayer is also seeking enlarging the petitioner on bail in Crime No.104/2021 of Sathnoor Police Station.
3. The records show that the matter involves the offence under Section 3(2)(v) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 2015 along with the offences under Sections 302 and 201 of IPC.
4. The records further show that the trial Court by
order dated 30.09.2021 rejected the bail application of the appellant. That was challenged before this Court in Crl.A.No.1685/2021. This Court considering the merits of the case, dismissed the said appeal on 04.01.2022. Thereafter the appellant filed Crl.A.No.354/2023 before this Court challenging dismissal of his another application by the trial Court by order dated 24.01.2023. That appeal was dismissed for non compliance of office objection.

5. If the appellant’s application is only for bail, there is no reason to bypass the trial Court. He shall seek such relief before the trial Court. Reserving such liberty to the appellant, the appeal is disposed of.
6. Registrar (Judicial) should seek explanation of the concerned for not raising objection regarding maintainability of the appeal. Sd/- (K.S.MUDAGAL) JUDGE
