ORAL ORDER
In this petition, petitioner seeks for the following reliefs:-
“WHEREFORE, the petitioner humbly pray that this Hon’ble Court be pleased to quash the entire proceedings Presently registered as SC No.125/2025 pending on the file for VI Addl. Dist & SJ at Bengaluru, for an offences punishable under Section 504, 506 & 376 (2) (n) of IPC registered by Byadarahalli P.S., Bengaluru in the interest of justice.”

Learned counsel for the petitioner – accused No.1 and
learned counsel for 2nd respondent – complainant have filed a Joint Memo accompanied by an Affidavit both dated 01.07.2025 duly signed by the petitioner, 2nd respondent and their respective counsel and the same is taken on record. 3. Petitioner – accused No.1 and respondent No.2 – complainant and their respective counsel are physically present

before the Court and they admit the contents of the aforesaid Joint Memo, which reads as under:-
“ JOINT MEMO UNDER SECTION 309/W 528 OF THE BHARATIYA NAGARIK SURAKSHA SANHITHA - 2023
1. The petitioner and 2nd respondent submits that both were known each other and had love affair since last Two years they leaved together for short period due to some misunderstanding she lodge a complaint against the petitioner alleging that she asked the petitioner to marry her but he refused and abused and threatened her with dare consequences hence she requested the 1 respondent Police to take legal action they registered in their Crime No.553/2024 for offences punishable under section 376,417,420, 504,506 of IPC. and conducted investigation and filed charge sheet against the petitioner in CC. No. 11973/2024, its SC.No. 125/2025 for an offences punishable under section 504,506,376, 420, 417 34 of IPC, now pending before Hon'ble VI Addl. District and sessions judge, Bangalore rural District. 2. we state that the petitioner and 2nd respondent entered in to compromise before the elders of the family and well-wishers not to proceed the criminal case each other with free will and consent an there was no force or threat each other in their personal life a they agreed they will not interfere with each other. 3. we submits that in terms of the settlement arrived between parties the respondent No.2 has agreed to withdraw the proceedings pending SC.No.125/2025 by its Crime

No.553/2024 of Bydarahalli Police Bangalore District, for an offences punishable under section pending before the Hon'ble VI Addl. District and sessions judge, Bangalore rural District. 5. we submits that there has been no collusion or force fraud or any undue influence entering into this compromise in the aforesaid manner similarly both the parties have no future claims each other. 6.
we submits that the parties have affixed our signatures with heir free consent without having any misrepresentation, fraud and undue influence
Wherefore we prayed before this Hon'ble court be pleased ash the further proceedings in SC.No.125/2025 of Byadaraha ice Bangalore 504,506,376,420,417 34 of IPC registered Byadarahalli Police Bangalore pending on the file of VI Addl. District and Sessions Judge Bengaluru Rural district, Bangalore against the petitioners in the ends of justice.”
4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following:
ORDER
(i) Petition is disposed of in terms of the Joint Memo accompanied by an Affidavit both dated 01.07.2025.
(ii) The proceedings in S.C.No.125/2025 (C.C.No.11973/2024) (arising out of Crime No.553/2024 registered

by the 1st respondent – Police) for the offences punishable under Sections 504, 506 and 376(2)(n) of IPC, pending on the file of VI Addl.District and Sessions Judge, Bangalore, insofar as the petitioner is concerned are hereby quashed.
