ORDER: (Per Hon]ble Sri Justice Battu Devanand) This Writ Petition has been filed to declare the inaction of the respondents in not considering' the repr,esentations dated 03.03.2025 and 25.07.2025 of the petitioner, wherein he requested to return his vehicle which was seized by the respondent Nos.2 and 3. 2. Learned counsel for the petitioner would submit that in the year 2022, he purchased Volkas Wagon Whole Car bearing Registration No. AP 39 MP 9352 by obtaining loan from lCICI Bank. One Mr. B.Karthik, partner of M/s. Lakshmi Siddi Jewellers and Bullion, Guntur, who is the petitionerJs friend requested him to give his car for 15 days to attend his family functions in the last week of December 2024. The petitioner accepted his request and handed over his car to him. 3. While the matter stood thus, Mr. B.Kar{hik, informed the petitioner that due to some business urgency, he sent his car along with known persons i.e. S.Praveen Kumar and Ch.Venkata Veeranjaneyulu, who carried gold belonging to his shop to Chennai for business purpose and on return journey, his car was intercepted by Customs Officers on 09.01.2025. The petitioner was also informed that the Customs O`fficers seized the gold found in
possession of the above said two persons. Mr. B.Karthik also informed the petitioner that he would explain the facts to the Customs authorities and See tO get the car released within ten days. However, it is understood that Customs officers have conducted further proceedings in this regard which may take substantial time to conclude the said proceedings. Under those circumstances, the petitioner submitted application on 03.03.2025, for release of the car and later one more application on 25.07.2025, but there is no action I on the part of the respondents in cons'ldering the representation of the petitioner. Aggrieved by the inaction Of the respondents in considering the representation of the petitioner, he constrained to file the present writ petition. /
4. Heard learned counsel for the Petitioner and learned Standing counsel appearing for the respondent Nos.2 and 3. 5. The only grievance raised by the Petitioner in this Writ Petition iS with regard to non-consideration of the representation dated o3.03.2025 and 25.07.2025 submitted to the respondent No.2 to release his vehicle which was seized by the customs Officers on 09.01.2025. 6.
Considering the facts and Circumstances Of the Case, in Our considered view, instead of keeping this writ petition pending months together, it is appropriate and reasonable to dispose of the writ petition with a direction to the respondent No.2 to consider the representation Of the Petitioner in accordance with law within the time to be stipulated herein under to meet the interest of justice. 7. Accordingly, this writ petition is disposed of, with a direction to the respondent No.2 to consider the representations dated o3.03.2025 and 25.07.2025 of the petit,'oner in accordance with law and pass appropriate orders within a perl'od of three (o3) weeks from today and communicate the
order to the petitioner thereafter within one (o1 ) week.
