The petitioner, who is borrower, has approached this Court challenging order dated 11.11.2022 (Annexure P-7) issued u/s 14 of Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short SARFAESI Act), which can very well be assailed u/s 17 of SARFAESI Act. 2. However, the said remedy has not been availed by the petitioner- borrower, and even the amount of Rs.2,00,000/- has not been paid as per order dated 29.03.2023. 2.1 The petitioner has neither brought the amount of Rs.2,00,000/- by way of a bank draft or by any other mode today, which is the next date of hearing, nor has deposited the said amount with the Bank, and therefore, the stay order dated 29.03.2023 stands vacated. 3. The petitioner is relegated to avail the appropriate statutory remedy under the SARFAESI Act before the DRT and thereafter before DRAT.
