Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act. 3 . As per the prosecution case , 1067.4 liters of illivcit liquor was recovered from the seized pick up van of which petitioner is said to be registered owner. 4. It is submitted on behalf of petitioner that the sezied vehicle which was used in carrying illegal illicit liquor has already been stolen by 4 unknown miscreants for which driver of petitioner has filed Gangaur P S Case No. 945 of 2023 on 13.09.2023 i. e , Annexure – 2 to the bail petition and as Patna High Court CR. MISC. No.19782 of 2025(2) dt.19-04-2025 2/2 such this petitioner cannot be held responsible for the alleged offence . No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected with the alleged occurrence . Petitioner claims clean antecedent. 5 . Learned APP for the State vehemently opposed the bail application . 6. Considering the aforesaid facts and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise No. 1 Banka in connection with Dhankund P.
