No.1 and 2 pending before the Labour Court. The notice is not yet issued to the respondent. 2. It is noticed that the industrial dispute is raised in the year 2022. It appears that respondent has filed an application contending that there is a valid arbitration clause between the petitioner and respondent as such, the Labour Court has no jurisdiction to decide the dispute. 3. The petitioner claims to have filed objection to the said application and that application is not yet decided. In addition, the petitioner has claimed he also filed an application for early disposal of the proceeding. It is stated that applications are filed in the year 2023. - 3 - HC-KAR NC: 2025:KHC:23925 WP No. 19264 of 2025 The order sheet prima-facie suggests that the applications are not yet decided. 4. The Industrial Disputes Act, 1947 mandates expeditious disposal of industrial disputes. This Court is also aware that the Labour Courts are burdened with huge number of cases pending before it. Nevertheless, considering the spirit of the Industrial Disputes Act, 1947, the Labour Court is requested to dispose of the pending applications by taking into consideration the urgency pleaded. 5. Both the parties shall cooperate for early disposal of the pending applications. 6. This Court is also conscious of the fact that this order is passed without notice to the respondent as this Court is of the view that this order does not affect the right of the respondent. - 4 - HC-KAR NC: 2025:KHC:23925 WP No. 19264 of 2025 7. Nevertheless, considering the fact that respondent is not heard, liberty is reserved to the respondent to file an application for modification of the order, if so advised. 8.
