Having heard learned counsel for the petitioner, this Court is of the considered view that the petitioner would be well advised to raise these issues by way of a suit before Civil Court as issues raised herein are not to be decided by this Court under Article 226 of the Constitution of India. 3. Accordingly, this petition is dismissed, with liberty to the petitioner to have remedy under Section 9 of the Civil Procedure Code and any other Statute as may be available to the petitioner.
