No.2141 OF 2025 The Court made the following ORDER :- The revision petitioner is the 3rd plaintiff in O.S.No.26 of 2014 on the file of the Court of Additional District and Sessions Judge, Narsapur. Originally, the husband of petitioner and the 2nd plaintiff filed the above suit for partition of the plaint schedule property into 25 equal shares by metes and bounds and allot 6 such shares to the plaintiffs 2 to 5 and put them in possession thereof. During pendency of the suit, the 1st plaintiff died. The wife and children of the deceased 1st plaintiff were added as plaintiff Nos.3 to 5. 2. Though the suit was filed in the year 2014, till today the said suit was not disposed of, is the only grievance of the Civil Revision Petition. Moreover, the 1st plaintiff is no more and the 2nd plaintiff is aged about 85 years. Hence, learned counsel for the petitioner seeks an innocuous relief seeking a direction to the learned trial Judge to take up O.S.No.26 of 2014 as expeditiously as possible. 3. Since no adverse orders are going to be passed against the respondents in this Civil Revision Petition, in the considered opinion of this Court, no notice is required to serve on the respondents. 4. In that view of the matter and in view of the innocuous relief sought by the petitioner, the present Civil Revision Petition is disposed of, at the stage of admission, directing the learned Additional District Judge, Narsapur, to take up O.S.No.26 of 2014 and dispose of the same in accordance with law after hearing both sides within a period of six (06) months from the date of receipt of a copy of this order. 4 KSR,J C.R.P. No.2141 OF 2025 5. Accordingly, with the above direction, the Civil Revision Petition is disposed of, at the stage of admission.
