IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 1696 of 2025 Uday Nath Mahto, aged 41 years, son of late Meghnath Mahto, resident of Karma, Bhandaridih, P.O. and P.S. Kashmar, District- Bokaro. … Petitioner - Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. P. S. Dayal, Advocate For the State : Mrs. Priya Shrestha, Spl.P.P. --- 02/06.03.2025 Heard the parties. The petitioner has been made accused in connection with S.T. Case No.250 of 2024, arising out of Kashmar P.S. Case No. 66 of 2012, (G.R. Case No.1227 of 2012), for the offences registered under Sections 366A, 376(G)/34 of the I.P.C., pending in the Court of learned Additional Sessions Judge-II, Bermo at Tenughat. On 14.11.2012, the petitioner along with co-accused persons kidnapped the daughter of the informant and thereafter, she was gang raped. Learned counsel for the petitioner submitted that medical injury does not support the allegation. Learned A.P.P. has opposed the prayer for bail and submitted that the petitioner has absconded for 13 years. In view of the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. The learned trial court shall expedite the trial. (Ambuj Nath, J.) Jay/-
