GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ of Mandamus declaring the action of respondent no 3 in not providing Police protection preventing the interference of the respondents 48 herein with peaceful possession of property belonging to the petitioner situated in RS no 121 admeasuring Ac 0 19 cents or 919 6 square yards in Kannapuram village Near Yarraigudem Road Airtel Tower Koyyalagudem Mandal West Godavari District despite there is an order of injunction vide its orders in lA NO 206 of 2020 in OS NO 43 of 2020 dated 18 08 2020 on the file of Junior Civil JudgecumJudicial Magistrate of First Class Jangareddigudem despite the complaint made by the petitioner as illegal arbitrary and violation of principles of Natural justice and also the violation of Art 21 and 300A of Constitution of India and consequently direct the 3rd respondent to provide police protection in respect of peaceful possession of property belonging to the petitioner situated in RS no121 admeasuring Ac 0 19 cents or 919 6 square yards in Kannapuram village Near Yarraigudem Road Airtel Tower Koyyalagudem Mandal West Godavari District as expeditiously as possible” 2. Heard Sri K.Satish Sharma, learned counsel for the petitioner and Sri Md.Farooq, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the petitioner herein filed a civil suit against unofficial respondents and obtained temporary injunction on merits. 4. Learned Assistant Government Pleader for Home would submit that they have not received any representation from the petitioner seeking police protection. 3 5. At this juncture, learned counsel for the petitioner would submit that the petition may be disposed of, granting liberty to the petitioner to submit a representation to the police in case of any imminent danger from the side of the unofficial respondent, seeking police protection in light of the judicial order 6. Considering the submissions made, and since there is a judicial order in favor of the petitioner on merits regarding the temporary injunction over the subject property against the unofficial respondents, the petitioner is at liberty to submit a representation in case of imminent danger to his property. Upon submission of such representation, the police are directed to act in accordance with the governing Rules and Law until the injunction remains in force in favor of the petitioner. 7. With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.
