Respondent(s) For Petitioner : Mr. Raja Sharma, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 30-06-2025 1) At the very outset, learned counsel for the petitioner seeks permission of this Court to withdraw this petition as there is efficacious alternative remedy available to it. He further submits that liberty may be granted to prefer duly constituted appeal before the appellate authority under Payment of Gratuity Act, 1972 along with application restraining the authority to not disburse the amount till disposal of appeal. 2) The prayer made by Mr. Sharma appears to reasonable. 2 3) Consequently, this writ petition stands dismissed as withdrawn. However, if petitioner prefers appeal before the appellate authority under the Act, 1972, it is directed that same shall be considered by the authority concerned strictly in accordance with law. It is also directed that application for grant of stay, if any moved by the petitioner, same shall be decided at the earliest, preferably within period of 15 days from the date of its presentation. 4) Certified copy be returned after retaining its xerox copy.
