Petitioners have been made an accused in connection with Haidarnagar P.S. Case No. 147/2020, Corresponding to POCSO Case No. 53/2021, for the offence under sections 376-D/506/34 of the Indian Penal Code and Section 6 of the POCSO Act, pending in the court of learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj. On 21.11.2020 at about 07:00 P.M., the accused persons are alleged to have dragged the victim towards a field and gang raped her. It was submitted that the statement of the victim has been recorded during the trial in which she has supported the occurrence but she has not identified the petitioners as the person who had raped her. The victim has been declared hostile.
Regard being had to the facts and circumstance of the case, the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj in connection with with Haidarnagar P.S. Case No. 147/2020, Corresponding to POCSO Case No. 53/2021.
