Ajay Mohan Goel, Judge (Oral) Learned Additional Advocate General has handed over a copy of Instructions, received from Assistant Collector, 1st Grade, Ghumarwin, District Bilaspur, H.P., in terms whereof, the encroachment proceedings initiated against father of respondent No.5 have attained finality and the Warrant of Ejectment has also been executed on the spot on 11.07.2023. These Instructions are taken on record. If that is so, then it is not understood as to why the order passed by the Hon’ble Division Bench of this Court, dated 29.08.2022, in terms whereof, the representation of the petitioner 1 Whether reporters of the local papers may be allowed to see the judgment?
2 2025:HHC:42021 was to be decided within a time bound period is not being acted upon by the Authority concerned. This demonstrates either malafide on behalf of the Authority concerned or Colourable Exercise of Power.
2. Learned Additional Advocate General submits that the representation shall be decided within a period of three weeks from today. His statement is taken on record. It is further observed that in case the encroachments proceedings initiated, i.e. the encroachment proceedings against respondent No.4 have also attained finality, then appropriate call on the representation of the petitioner qua him shall also be taken within three weeks.
3. The petition stands disposed of. Pending miscellaneous application(s), if any also stand disposed of accordingly.
