Mr. Gourav Das Ms. Tuli Sinha …for the State. 1. Heard learned Advocates appearing for the respective parties and considered the material on record. 2. The writ petitioner complains that despite the petitioner being extended the benefits of postgraduate scale of pay with effect from August 10, 1999 and despite payment of arrears in respect of such higher scale of pay being made to him on March 31, 2018, the petitioner has not been paid interest on such arrears. The petitioner claims that he is entitled to interest on the arrears of the postgraduate scale of pay extended to him with effect from August 10, 1999, which was actually paid to him on March 31, 2018. 3. In view of the nature of grievance raised by the petitioner in this writ petition, this Court is of the view that the respondent no.3 i.e. the District Inspector of Schools (SE), Nadia, should take a 2 decision in this regard at the first instance. The writ petitioner shall be at liberty to make representation containing all relevant documents in support of his request for payment of interest on arrears of the benefit of postgraduate scale of pay extended to him with effect from August 10, 1999. 4. If such representation is made by the writ petitioner to the respondent no.3, the respondent no.3 shall consider and dispose of such representation within a period of three weeks from the date of receipt of such representation, by passing a reasoned order strictly in accordance with law upon giving an opportunity of hearing to the petitioner and the School Authorities i.e. the respondent nos. 4 and 5. 5. It is needless to mention that this Court has not gone into the merits of the petitioner’s case and that the respondent no.3 shall be at liberty to take a reasoned decision strictly in accordance with law. 6. With the above observations the writ petition being WPA/13728/2018 stands disposed of. 7.
