Petitioner has been made an accused in connection with Barhait P.S. Case No. 37 of 2024 (POCSO Case No.40 of 2024), registered under Sections 376DA, 306/34 of the Indian Penal Code and Sections 4/8 of the POCSO Act., pending in the Court of learned Special Judge, POCSO Act, Sahibganj. On 11.04.2024, daughter of the informant committed suicide. Before committing suicide, she had told her mother that she had eloped with this petitioner, but after raping her, he had sent her back home. Learned counsel for the petitioner submitted that co-accused Bikash Turi and Riyajul Ansari have been granted bail by this Court earlier. It was further submitted that the victim was medically examined and no sign of rape was found on the person. Learned A.P.P. has opposed the prayer for bail and submitted that there is direct allegation against the petitioner that he had raped the victim, due to which she committed suicide. In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected at this stage. (Ambuj Nath, J.) Jay/-
