2025:JHHC:16917 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 143 of 2025 ------ Manoj Kumar, son of Badri Sao, resident of village Hendehas, P.O and P.S Barwadih, District- Latehar. ..... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Nilesh Kumar, Advocate. For the State : Mr. Manoj Kr. Mishra, A. P.P. …..... 04/25.06.2025: This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Section(s) 376D IPC in connection with Manika P.S. Case No. 67/2019 (G.R. No. 246 of 2021) pending in the Court of learned ACJM, Latehar. Heard the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the State to oppose the bail, which the State availed and opposed. There is allegation of gang rape against the accused persons, but there is nothing on record against this petitioner. After investigation, final form was submitted exonerating the petitioner. The court concerned, after going through the case diary differed with the final report and has taken cognizance for the offence, as alleged. Summons have been issued to the petitioner. It was directed to bring on record the case diary and the same is on record. In paragraph 63 of the case diary, it has been mentioned that three different cases have been filed by the informant against three different persons, wherein allegation of rape has been made on the assurance of marriage. Be that as it may, since the cognizance has already been taken in this case, the petitioner should appear before the Trial Court and face the trial. Thus, I direct the petitioner to appear before the Trial Court and furnish his bail bonds. The Trial Court will frame charge within a month and proceed with the trial as early as possible with further direction to the petitioner to cooperate with the trial. Accordingly, this application stands disposed of. Anu/-C.P.-3 (ANANDA SEN, J.)
