Accused no.2 in Crime No.187/2025 registered by Hunusur Rural Police Station, Mysuru District, for the offences punishable under Sections 352, 126(2), 351(2), 54, 109, 3(5) of BNS, 2023, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.187/2025 was registered by Hunusur Rural Police Station, Mysuru District, for the aforesaid offences against Pramod and others based on the first information dated 22.04.2025 received from Vinay who is the friend of injured Dore @ Raju. During the course of investigation, petitioner was arrested on 21.05.2025. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.5121/2025 was rejected on 03.06.2025. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that the accused persons, injured and the first informant are all friends. In the alleged incident that had taken place on 21.04.2025 in front of a bar and restaurant at about 9.30 p.m., - 3 - HC-KAR NC: 2025:KHC:25620 CRL.P No. 9072 of 2025 the allegation of assaulting the injured with a beer bottle is as against accused no.1. The allegation against the petitioner herein and the other accused persons is that they had instigated accused no.1 to assault injured Dore @ Raju. Petitioner is in custody in the present case from 21.05.2025. Considering the nature of allegations found against him in the first information, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.187/2025 registered by Hunusur Rural Police Station, Mysuru District, for the offences punishable under Sections 352, 126(2), 351(2), 54, 109, 3(5) of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 4 - HC-KAR NC: 2025:KHC:25620 CRL.P No. 9072 of 2025 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
