Heard Mr. Ajoy Pebam, learned counsel for the petitioner/ applicant and Mr. H. Samarjit, learned PP for the State respondent. [2]
By the present application, the petitioner prays for leaving the State of Manipur for medical treatment/check up at Apollo Cancer Centres of Appollo Speciality Hospital, Chennai for a period of 30 days (one month) w.e.f. 11.11.2025 to 11.12.2025. [3]
Vide order dated 05.08.2025 in AB No. 23 of 2025, this Court granted pre-arrest bail to the petitioner with the following conditions: a) The petitioner shall furnish personal bond of Rs. 50,000/- (Rupees fifty thousand) with one surety (Govt. Employee) of the like amount. b) The petitioner shall co-operate with the investigation. c) The petitioner shall not tamper with the evidence or influence witnesses. d) The petitioner shall not leave Manipur without leave of this Court. e) On breach of any of the aforesaid conditions, the respondent is entitled to take appropriate action against the petitioner in accordance with law. [4]
It is submitted that ‘clause d)’ of the above conditions directed the petitioner not to leave Manipur without permission of this Court. In the circumstances, the present application is filed for taking permission and mandating report has been annexed. [4]
Mr. H. Samarjit, learned PP submits that while granting permission, this Court may pass appropriate directions so that the applicant does not abscond. [5]
This Court has perused the materials on record and the
submissions made at the bar. [6]
It is seen that the petitioner is a cancer patient and she requires regular medical treatment and for this purpose, she has to leave Manipur for Chennai for further treatment. [7]
In the circumstances, the application is allowed and the petitioner is permitted to leave Manipur w.e.f. 11.11.2025 to 11.12.2025 subject to the conditions that when return to Manipur, she shall report to the I.O. of the case within 1(one) week and submit a copy of the same to this Court. [8]
With these observations, the Crl. M.C. No. 43 of 2025 is allowed. [9]
List the remaining cases on 15.12.2025. [10]
Furnish a copy of this order to the learned counsel appearing for the parties.
