Present Mr. Ajoy Pebam, learned counsel for the petitioner and Mr. HS Paonam, learned sr. counsel assisted by Mr. Shushruta Yuman, learned counsel for the respondent. [2]
Mr. HS Paonam, learned sr. counsel for the returned candidate submits that he is filing an application for dismissal of the election petition on the ground that the petitioner has already divorced his wife and non-disclosure of the income of the wife as well as non-dependent children would not be a ground for filing the election petition. [3]
Accordingly, the MC(El. Pet.) No. 59 of 2022 is dismissed as withdrawn with liberty to file a fresh one, if so advised. [4]
