The plaintiff is the revision petitioner before this Court. The suit is filed for partition and permanent injunction restraining the 12th defendant and his men and agents from in any manner altering the physical features of the suit property and for various declarations. 4. A perusal of the “B” Diary extract would show that the 8th defendant had passed away and steps are pending. Without the legal heirs of the 8th defendant being impleaded and the suit amended accordingly, directions cannot be issued to the trial Court for expediting the trial.
