Vishal Bhukta vs. State of H. P. & Ors. Item No.
D-8
CMP(M) No. 1505 of 2025 25.11.2025 Present: Mr. Sanjeev Bhushan, Senior Advocate with Mr. Rajesh Kumar, Advocate, for the applicant/appellant. Mr. Sidharth Jalta, Deputy Advocate General, for respondents No. 1 to 3-State. Notice. It is argued that the matter was pending before the learned Single Judge in a review petition, which was dismissed on 23.05.2025. The learned Single Judge of this Court was of the considered opinion that the relief claimed but not granted amounts to denial of the valid claim. The claim was primarily for consequential benefits from the date when he was wrongly denied the appointment.
2. Mr. Sidharth Jalta, learned Deputy Advocate General, accepts notice on behalf of respondents No. 1 to 3- State.
3. Keeping in view of the above, we do not find that there is any valid justification not to condone the delay of 1 year, 9 months and 26 days, as the appeal was filed on 23.06.2025 immediately after the dismissal of the review petition on 23.05.2025. Thus, we are of the considered opinion that sufficient cause has been made out for condonation of delay that has crept-in filing the appeal. There can be no defence by the State also, therefore, there is no need to file reply on behalf of the State.
4. Accordingly, the application is allowed and the delay in filing the appeal is condoned.
Application stands disposed of. LPA No.__________ of 2025 Appeal be registered. Counsel for the appellant submits that the issue in this appeal is only regarding the seniority. List on 06.01.2026. (G. S. Sandhawalia)
