Heard the parties. The petitioner has been made accused in connection with Lohsinghna P.S. Case No. 228 of 2023, for the offences registered under Sections 147, 148, 149, 302, 120B of the Indian Penal Code, pending in the court of Miss Avanika Gautam, learned A.C.J.M., Hazaribagh. On 07.10.2023 at about 09:30 A.M., accused persons had assaulted the deceased in front of Hari Om General Store due to which he succumbed to his injury.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against the petitioner. It was further submitted that co- accused persons have been granted bail by this Court as well as by Co-ordinate Bench of this Court and the case of the petitioner stands on similar footing. Mr. K. S. Nanda, learned counsel appearing on behalf of the informant has vehemently opposed the prayer for bail and submitted that during the course of investigation, statement of the some of the witnesses was recorded by the investigation officer. Some of the witnesses have stated specific role of co- accused persons, but there is general and omnibus allegation against the petitioner. It was further submitted that petitioner has got criminal antecedent. Considering the fact that similarly situated co-accused persons have been granted bail by this Court, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Miss Avanika Gautam, learned A.C.J.M., Hazaribagh or her successor, in connection with Lohsinghna P.S. Case No. 228 of 2023.
