Petitioner has been made an accused in connection with Nimiaghat P.S. Case No. 28/2022, Corresponding to Special POCSO Case No. 57/2022, registered for the offences under Sections 366(A) of I.P.C. and Sections 8/12 of POCSO Act, pending in the Court of learned Special Judge, POCSO Act, Giridih. Bail application of the petitioner has been earlier rejected twice by co-ordinate bench of this Court. The petitioner is alleged to have enticed 16 year old minor daughter of the informant to leave her lawful guardianship. Statement of the victim has been recorded during the trial in which she has stated that the petitioner had taken her forcibly to Kolkata. She has also stated that he had established physical relationship with her. The age of the victim is 16 years. Even her consent for physical relationship will be immaterial Regard being had to the facts and circumstance of the case; I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is hereby rejected. Learned trial court shall dispose of the trial as expeditiously as possible without giving any undue adjournment to the prosecution.
