GNANESWARA RAO MITTIREDDI Counsel for the Respondent(S): 1. GP FOR CIVIL SUPPLIES 4 VS,J W.P.No.22566 of 2025 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue writ of mandamus or any other appropriate writ order or direction to declaring the action of the respondents No.3 to 5 in insisting the petitioners to tender their resignation and without there being any order of suspension or cancellation by the competent authority by following due procedure under the Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018, is illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents No.3 to 5 not to harass the petitioners for submission of their resignations attached to shop Nos.0904019, 0904018, 0904022 and 0904026 in Chamadala-2, Chamadala, Brahmanakraka-2 and Brahmanakraka Agraharam respective Villages of Jaladanki Mandal, SPSR Nellore District, in respect of the petitioners’ shops and continue the supply of Essential Commodities to the petitioners’ shops as usual till their appointment is subsisting/valid and pass such other order or orders….” 2. The petitioner was appointed as a permanent fair price shop dealer in the year 1995, attached to shop No.0904019 of Chamadala-2 Village, Jaladanki Mandal, SPSR Nellore District; the 2nd petitioner was appointed as a permanent fair price shop dealer in the year 2010, attached to shop No.0904018 of the above said village; the 3rd petitioner was appointed as permanent fair price shop dealer in the year 1997 attached to shop No.0904022 of Brahmanakraka Village of Jaladanki Mandal, SPSR Nellore District and the 4th petitioner was also appointed as a permanent fair price shop dealer in the year 1997 attached to shop No.0904026 of B.K.Agraharam Village, Jaladanki Mandal, SPSR Nellore District. 5 VS,J W.P.No.22566 of 2025 3. The grievance of the petitioners is that though they have been running the fair price shops since the date of their initial appointment without there being any complaints either from the card holders or from the concerned authorities, in view of the political change in the Government, the 4th and 5th respondents are insisting the petitioners to submit their resignation for the respective shops. Challenging which, the present writ petition is filed. 4. Today, when the matter came up for hearing, learned Assistant Government Pleader for Civil Supplies, has furnished a copy of the instructions of the Tahsildar dated 19.08.2025, wherein it is stated that the respondent authorities have never insisted the petitioners to tender their resignation as contended by the petitioners in their affidavit. 5. Recording the same, the Writ Petition is disposed of by directing the respondent authorities not to interfere into the petitioners’ fair price shop without there being any complaint as against them.
