ORDER: ...RESPONDENT/COMPLAINANT The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik- Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/Accused No.1 for granting of bail in connection with Crime No.169 of 2025 of Anaparthi Police Station, East Godavari District, registered for the alleged offences punishable under Sections 318(4), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). The case of the prosecution is that on 21.07.2025 at 8;00 PM, the complainant Balusu Srinivasu, owner of Srinivasa Rice Mill, Pulagurtha, I reported that on the request of A1/Laskar Jangoji @ Jagan, A2/B. Manish Kumar, and A3/Siva Kumar, he sent 300 quintals of rice worth f9,75,000/- through an agent in lorry No. TS07UE8289 to Sri Saibalaji Agro Tech Mill, Kagaj Nagar, Telangana, managed by A4/Padma Renikuntia, A5/Madhuri Baddha, and A6/Surekha Buddha. The rice was received but the accused failed to pay and kept postponing payment. On inquiry, it was revealed that the accused have been cheating several persons in a similar manner. 3. Smt. T.V. Sridevi, the learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and has been falsely implicated by the police. It is further submitted that the petitioner is the sole earning member of the family and, he is ready to abide any conditions that may be imposed by this Court, and it is urged to grant bail to the petitioner. 4. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on bail, there is a strong likelihood that he may abscond, thereby hampering the ongoing
3 Dr.YLR, J Crl.P.No.8680 of 2025 Dated 30.08.2025 investigation and evading the process of law. In view of the foregoing, it is urged that the petition be dismissed. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 5.
As seen from the record, the allegation against the petitioner is that he acted as a commission agent for transferring 300 quintals of rice to Sri Sai Balaji Agro Tech F^ice Mill on 12.03.2024. The Managing Partners of the said rice mill failed to pay an amount of f9,75,000/- towards the said transaction, despite repeated demands by the de facto complainant. The learned Assistant Public Prosecutor submits that the investigation has been completed and a charge sheet has also been filed. The petitioner was arrested on execution of the PT warrant on 28.07.2025 and has been in judicial custody for the past 33 days. 6. 7. Considering the gravity and nature of the allegation levelled against the petitioner/Accused No.1, and his alleged role played in the case, this Court is inclined to enlarge the petitioner on bail with the following stringent conditions: i. The petitioner/Accused No.1 shall be enlarged on bail subject to he executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the learned Judicial I Class Magistrate, Anaparthi. 4 s Dr.YLR, J Crl.P.No.86S0 of 2025 Dated 30.08.2025 The petitioner/Accused No.1 shall Station House Officer concerned II. appear before the on every Saturday in between 10.00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court, iii.
