PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the f Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioner/Accused No.7 for granting of bail in connection with Crime No.199 of 2024 of Anaparthi Police Station, East Godavari District, registered for the alleged offences punishable under Sections 420 read with 34 of the Indian Penal Code, 1860 (for brevity ‘the I.P.C’). 2 Dr.YLR, J Crl.P.No.8681of 2025 Dated 30.08.2025 The case of the prosecution is that on 20.09.2024, the complainant Medapati Ananda Reddy, Managing Partner of Varahi Rice Industries, Ramavaram, reported that on 11.03.2024 he sold 310 quintals of rice worth ?10,07,500/- on credit to Al-Padma Renikuntia, A2-Madhuri Baddha, A3- Sreelatha Sanku, and A4-Surekha Buddha, Managing Partners of Sri Saibalaji Agro Tech Rice Mill, Sirpur Kagajnagar.
Despite repeated demands, the accused failed to pay the amount. On inquiry, it was revealed that the said rice mill has been cheating several persons in a similar manner. Hence, the present complaint was lodged. 2. 3. Smt. T.V. Sridevi, the learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and has been falsely implicated by the police. It is further submitted that the petitioner is the sole earning member of the family and, he is ready to abide dny conditions that may be imposed by this Court, and it is urged to grant bail to the petitioner. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on bail, there is a strong likelihood that he may abscond, thereby hampering the investigation and evading the process of law. In view of the foregoing, it is urged that the petition be dismissed. 4. ongoing

5. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 6. As seen from the record, the allegation against the petitioner is that he acted as a commission agent for transferring 310 quintals of rice to Sri Sai Balaji Agro Tech Rice Mill on 11.03.2025. The Managing Partners of the said rice mill failed to p'ay an amount of f10.07,500/- towards the said transaction, despite repeated demands by the de facto complainant. The learned Assistant Public Prosecutor submits that the investigation has been completed and a charge sheet has also been filed. The petitioner was arrested on execution of the PT warrant on 10.07.2025 and has been in judicial custody for the past 51 days. 7.
Considering the gravity and nature of the allegation levelled against the petitioner/Accused No.7, and his alleged role played in the case, this Court is inclined to enlarge the petitioner on bail with the following stringent conditions; i. The petitioner/Accused No.7 shall be enlarged on bail subject to he executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the learned Judicial I Class Magistrate, Anaparthi. ii. The petitioner/Accused No.7 shall appear before the Station House Officer concerned on every Saturday in between

The petitioner/Accused No.7 shall not leave the limits District without prior permission from the Station House Officer concerned, iv. The petitioner/Accused No.7 shall not commit or indulge in commission of any offence in future. V. The petitioner/Accused No.7 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. of the Vi. The petitioner/Accused No.7 shall not, directly or indirectly make any inducement, threat promise to any person I acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. or
