This writ petition is filed seeking following relief :- "A) a writ order or direction in the nature of Mandamus commanding/directing the respondents to make the payment of Gratuity, Provident Fund Earn Leave Arrears of Pension, and Group Insurance, of her deceased husband with interest for the post of Safai Karamchari (Class IV employee of Nagar Panchayat Sasni, Hathras. within the stipulated period granted by this Hon'ble court. B) a writ order or direction in the nature of Mandamus commanding/directing the respondents to grant the benefit of financial up-gradation/selection grade as well as the benefit of ACP (Assured Career Progression) to the petitioner admissible to him under the ACP Scheme and to re-fix the salary/monthly pension of the petitioner in accordance thereof. C) any other writ order or direction as this Hon'ble may deemed fit and proper in the facts and circumstances of the case. D) Award cost of the petition to the petitioner." Sri Arvind Kumar Trivedi, learned counsel for petitioner submits that claim of petitioner is still not decided. Sri Saurabh Tiwari, learned counsel for respondent Nos.4 and 5 submits that though he has not received instructions, however, considering the nature of prayer, claim of petitioner be considered in accordance with law by concerned respondent within short period. Learned counsel for petitioner on basis of above submission submits that this writ petition may be disposed of. In the aforesaid circumstances, instead of going into the merit of case, at this stage, an opportunity is granted to concerned respondent to decide the grievance of petitioner, in accordance with law within a short period and in case any legal impediment, the same shall be communicated to petitioner.
