Order 17/01/2025
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.313/2024, registered at Police Station C.P.S. Jaipur, District Anti Corruption Bureau (ACB) Jaipur for the offence(s) under Section 7 of the Prevention of Corruption (amendment) Act, 1988.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is alleged against the accused-petitioner that he demanded Rs.1500/- from the complainant and the accused-petitioner was arrested red- handedly with Rs.700/-. It is also contended that the accused- petitioner is in custody since 26.12.2024, the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
[2025:RJ-JP:2517] (2 of 2) [CRLMB-401/2025]
3. Learned Public Prosecutor has vehemently opposed the grant of bail application. It is contended that the investigation against the accused-petitioner is still pending and his voice sample is to be taken on 21.01.2025, therefore, the bail application of the accused-petitioner may be dismissed.
4. Heard and perused the material available on the record.
5. It is not desirable to express anything on the merits of the case, the accused-petitioner is in custody since 26.12.2024 and the trial/investigation of the case may take considerable time. Further the voice samples of the accused-petitioner can be obtained even if the accused-petitioner being released on bail and it is not necessary for that purpose the petitioner has to be remained in custody, therefore, taking into consideration the facts, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Deepak Goyal S/o Jagdish Prasad Goyal, in connection with FIR No.313/2024, registered at Police Station C.P.S. Jaipur, District Anti Corruption Bureau (ACB) Jaipur, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
