The applicant has preferred this 1st bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as he is arrested in connection with crime No. 117/2023, registered at Police Station – Kusmi, District- Balrampur-Ramanujganj (C.G.) for offence punishable under Sections 302 of IPC, 1860 (as per FIR) comparatively 103(1) & 238 of BNS, 2023. 2. 2 gone to attend the village fair at Umko and did not return home by evening. Despite inquiries made in the neighborhood and among relatives, her whereabouts could not be ascertained. During the investigation, the dead body of the missing girl was found in a mutilated condition on 13.11.2023 in the forest area of Karmi Katari Kona village. During the inquest, the cause of death was found to be homicidal in nature. Accordingly, crime was registered against an unknown person. During the course of investigation, the accused Ravishankar alias Bhagat was interrogated and his memorandum statement was recorded. The auto-rickshaw used in the commission of the offence was seized. Based on above, offense has been registered against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. The applicant has no involvement in the alleged crime. There is no eye-witness in this case. The FSL report is negative. Only an auto-rickshaw has been sized from him. The only allegation against the applicant is that he was last seen with the deceased. The incident occurred between November 6, 2023 to November 13, 2023 and the applicant was arrested after two years i.e. on 25.03.2025 and since then he is jail.
The charge-sheet has filed, the trial has not commenced and is likely to take time to be finalized, therefore, it is prayed that the applicant may be enlarged on bail. 4. Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that the applicant was last seen with the deceased by Arjun and Chardraprakash. As per the statement of the deceased's father, the applicant had misbehaved with the deceased in the past as well, therefore, looking to the nature of offence, the applicant may not be granted benefit of bail. 5. I have heard learned Counsel appearing for the parties and perused the material available on record. 6. Considering the facts and circumstances of the case, evidence collected by the prosecution against the applicant and the fact that the applicant was last seen with the deceased by witnesses Arjun and
3 Chardraprakash and he had misbehaved with the deceased in the past as well, further considering that the trial has also not commenced, at this stage, without further commenting on merits of the case, I am not inclined to release the applicant on bail. 7.
