The present application under Section 528 of Bharatiya Nagarik Suraksha Sanhita, has been filed to quash the order dated 05.12.2024 passed by Additional Chief Judicial Magistrate, Court No. 2, Varanasi in Application No. 2994 of 2024 (Rukhsar Bano Vs. Manoj Pandey), under Section 175(3) of B.N.S.S. whereby the learned Magistrate, passed an order to investigate the matter under Section 175(3) of B.N.S.S. (under Section 156(3) of Cr.P.C.). Learned counsel for the applicant fairly admits that the present applicant is a proposed accused. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
