Heard the parties
2. Petitioners are apprehending their arrest in connection with Pindrajora P.S. Case No. 60 of 2017 corresponding to G.R. Case No. 999 of 2017, for the offences registered under Sections 3, 4, 6, 10 of the Jharkhand Conduct of Examination Act and Section 420 and 120B of the I.P.C., pending in the Court of Sri Kishore Kumar, learned Judicial Magistrate, 1st Class, Bokaro.
3. Anticipatory Bail Application of the petitioners was earlier rejected by this Court vide A.B.A. No. 2404 of 2024 by order dated 20.06.2024.
4. Petitioners were invigilators in the examination conducted at All India Commercial Crafts Industrial Training Institute at Bokaro on 05.08.2017. It is alleged that the informant came to know that mass scale cheating was going on at the center. The Informant party raided the center and apprehended several co-accused persons who were involved in cheating. It further appears that photocopy of the solved answer papers were also recovered from the students. The petitioners were invigilators in the said examination.
5. The occurrence is alleged to have taken place in the year 2017 and the Anticipatory Bail Application No. 2404 of 2024 was filed after seven years.
6.
Learned counsel appearing on behalf of the petitioners has submitted that the petitioners are teachers and they have been made scapegoat.
7. The petitioners being invigilators were involved in mass scale cheating in the center, where the examination of All India Commercial Crafts Industrial Training Institute at Bokaro was being conducted.
8. In view of the aforesaid facts, I am not inclined to extend the privilege of anticipatory bail to the petitioners. Accordingly, their prayer for Anticipatory Bail stands rejected.
9. Despite of the fact that earlier Anticipatory Bail application filed by the petitioners was rejected by this Court on 20.06.2024, petitioners have not yet surrendered before the learned Court below. The concerned Court is
directed to take all coercive steps to secure the attendance of the petitioners.
