Sri Gaurav Bishan, advocate, has put in appearance on behalf of the petitioner. 2. The petitioner is aggrieved by an order dated 25.10.2023 passed by Additional District Magistrate, Finance & Revenue, Farrukhabad in Case No. 230 of 2022 under Section 51 of the Food Safety and Standard Act, 2006. The Additional District Magistrate exercising the power of the Adjudicating Officer has imposed penalty upon the petitioner under Section 51 of the Act. The consequential recovery is also under challenge. 3. It has not been disputed before us that against such an order, appeal would be maintainable before the Appellate Tribunal constituted under Section 70 of the Act. 4. Consequently, we decline to entertain the challenge as the issues sought to be raised are factual in nature, and permit the petitioner to approach the Appellate Tribunal. 5.
