This petition has been filed for a direction to be issued to conduct an inquiry against the doctors of the concerned composite hospital at Sikandarabad, District Bulandshahar. According to the petitioner, the doctors have shown utmost negligence in treating the wife of the petitioner. This petition is opposed by learned Standing Counsel, who points out that there is already an FIR lodged against the petitioner for having assaulted certain doctors of the hospital and filing of the writ petition is purposive. Learned counsel for the petitioner states that prior complaint was made by the petitioner, which has not been accorded consideration. If that be so, remedy of the petitioner would be to approach the concerned Magistrate. Once, the criminal proceedings have been set in motion, we would not be justified in embarking upon factual inquiry to cause interference in such matters, particularly when proper investigation is yet to be carried out and concluded pursuant to the FIR lodged in the matter. Filing of the writ petition at this stage is not countenanced. The writ petition is, accordingly, dismissed.
