Mr. Diwakar Dev Sharma, Additional Advocate General, for respondent No.2 The instant application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that impugned judgment was passed by the learned District Judge, Mandi Division, District Mandi, on 06.06.2025. It has further been averred in the application that the dismissal of the case was not within the knowledge of the applicant/appellant as the same was never intimated to the applicant by its counsel. It has been averred that earlier also due to in-efficiency and lackadaisicat attitude of law firm/counsel the cases were withdrawn from the law firm namely, M/s M.V Kini and Company vide letters dated 20.09.2023 and 26.09.2023. It has further been averred that on 15.09.2025, the applicant enquired from the law firm about the pendency of all the cases, it is only then it came to the knowledge of the applicant/appellant that the objection petition had been disposed off. It has further been averred that the certified copy of the impugned judgment was applied on 18.09.2025 and the same was supplied on 24.09.2025. It has been further contended by the learned counsel for the applicant/appellant that the delay in filing the appeal is neither intentional nor willful but the same has occurred due to unavoidable circumstances, which were beyond the control of the applicant/appellant. Keeping in view the averments as made in the application, which is duly supported by an affidavit and keeping in view of the fact that the learned counsel appearing for the respondents have no objection in case the delay is condoned, the present application is allowed and the delay in filing the present appeal is condoned.
