This petition has been filed with the following prayers: “In the light of the facts and grounds stated hereinabove, it is most respectfully prayed that this Hon'ble Court may be pleased to: 1. Issue a writ of certiorari and/or mandamus or any other appropriate writ, order or direction quashing the impugned e- auction result dated 23.07.2025 (Auction Ref. 18263) conducted by Respondent No.3 MSTC on behalf of Respondent No.2 IOCL, Paradip Refinery, in so far as it finalizes the sale of sulphur to Respondent No.4. 2. Direct Respondents No.2 and 3 to preserve and produce before this Hon'ble Court the complete audit trail, bid logs, server response codes, exception/error logs, and all electronic records relating to the auction session dated 23.07.2025, including any help-desk tickets and internal communications. 3. Issue a writ/order of mandamus directing Respondents No.1-3 This is a digitally signed order. Pass interim orders restraining Respondents No.2 and 3 from issuing or acting upon any Delivery Order (DO) or permitting lifting of the sulphur lot in question by Respondent No.4, namely JK Enterprises, Shamli, Uttar Pradesh, during the pendency of the present petition. 5. Direct Respondents No.2 and 3 to consider the Petitioner's grievance dated 08.08.2025 (CPGRAMS Reg. No. MPANG/E/2025/0009943 - Annexure 5 & 7) and decide the same through a reasoned and speaking order after affording the Petitioner a fair hearing.” 2. In effect, the petitioner impugnes the re-auction which was held on 23.07.2025 conducted by the respondent no.3 on behalf of respondent no.2/Indian Oil Corporation Ltd. Paradip Refinery. 3. Mr. Ghanshyam Dwivedi, General Manager (Material and Contracts), Indian Oil Corporation Ltd./respondent no.2 states that after the award of the tender in favour of the respondent no.4/J.K. Enterprises, the waste material including sulphur, has been lifted/transported. In other words, the work related to the tender is complete. 4. If that be so, as the purpose of the tender having been achieved, noting the prayers made in the writ petition, the present writ petition has become infructuous and we order so. V.
