judgment and order, dated 29.12.2016, passed in a batch of writ petitions bearing Nos.23678, 23832, 23833 and 23834 of 2004; 4992, 5764, 9067, 12280, 12430, 12439 and 12460 of 2005; 17387, 21938 and 27278 of 2006. Even when various petitions came to be decided by virtue of the common judgment and order which is being challenged in these proceedings, yet only one appeal bearing W.A. No.301 of 2017 has been filed.

No: 301 of 2017 Since the appeal has been preferred against only one of the respondents/writ petitioners and not others, in our opinion, the appeal preferred must fail on the ground of res judicata, as the judgment in the other cases has become final.
