Sridevi, Standing Counsel for Dr. NTR University of Health Sciences Advocate for Respondent; CORAM :THE CHIEF JUSTICE DHIRAJ SINGH THAKUR SRI JUSTICE RAVI CHEEMALAPATI DATE : 19^*’August 2025 PC : The petitioner has preferred this petition challenging his non consideration as a local candidate on the ground that even when he had studied in the State of Andhra Pradesh for four consecutive years preceding the qualifying examination, he ought to have been categorized as a ‘local candidate’ and permitted to be considered as such for the 85% seats which have been reserved for local candidates in terms of the advertisement notification and the rules. \ 2 HCJ a RC, J W.P. No; 21902 of 2025 However, on a perusal of the prospectus which contains the relevant conditions regarding eligibility as a local candidate, it can be seen that in terms of clause 7.3(A) of the notification, an applicant could have been considered to be a local candidate if he had studied in an educational institution in such a local area for a period of not less than four consecutive academic years ending with the academic year in which he had appeared or first appeared in the relevant qualifying examination. 2. In the instant case, the data that has been placed on record by the petitioner would show that the petitioner had studied in two different local areas falling within the jurisdiction of Andhra University and Sri Venkateswara University during the last four years preceding the qualifying examination. If that be so, then certainly the petitioner cannot be considered as eligible as a local candidate in terms of clause 7.3(A)(a). The petitioner also is not eligible to be considered as a local candidate in terms of clause 7.3(B) of the relevant eligibility condition inasmuch as the petitioner would have been eligible only if he had studied in an educational institution in the State for a period of not less than seven consecutive academic years ending with the academic year in which he/she appeared for the relevant qualifying examination. It appears that the petitioner, having studied in the State of Karnataka 3. for classes VI and VII in the years 2019 and 2020, cannot, therefore, claim to 3 HCJ a RC, J W.P. No: 21902 of 2025 have studied consecutively for a period of seven years in the State, which would otherwise entitle him to be considered as a local candidate. 4. We are of the opinion that the present petition is without merit and is, accordingly, dismissed. No costs.
