(Oral) At this stage, the counsel for the respondent submits that he has no objection, if the transfer application is allowed. Learned counsel for the parties heard. The applicant-wife has filed the present application for seeking transfer of the petition under Section 13 of the Hindu Marriage Act i.e. HMA/122/2023, titled ‘Ajay Vs. Megha Sharma’, filed by the respondent- husband, pending in the Family Court (Camp Court) Baba Bakala, District Amritsar and she seeks transfer of the same to the Court of competent jurisdiction at Batala, District Gurdaspur. In view of the submission made by the counsel for the respondent, it is pertinent to mention that the marriage between the parties to the lis, had taken place on 10.12.2009. One son born from the said wedlock, is presently in the care and custody of the respondent. Further, it is not disputed that the petition under Section 125 Cr.P.C., as well as the petition Anu 2025.03.26 15:57 I attest to the accuracy and authenticity of this document 2 TA-310-2024 under the Protection of Women from Domestic Violence Act, filed by the applicant, are pending in the Courts at Batala and the respondent is making appearance in the same. On query by the Court, it is submitted by the counsel for the applicant that the applicant is not working and as such, has no source of earning. In view of the aforesaid fact situation and also considering the statement made by the counsel for the respondent, the transfer application is allowed and the petition under Section 13 of the Hindu Marriage Act i.e. HMA/122/2023, titled ‘Ajay Vs. Megha Sharma’, filed by the respondent- husband, stands transferred from the Family Court (Camp Court) Baba Bakala, District Amritsar, to the Court of competent jurisdiction at Batala, District Gurdaspur. The requisite record of the aforesaid case be sent by the Family Court (Camp Court) Baba Bakala, to the District and Sessions Judge, Gurdaspur. Learned District and Sessions Judge, Gurdaspur, shall assign the said petition to the Family Court (Camp Court) Batala. Even, the parties are directed to appear before the Family Court (Camp Court) Batala, within a period of one month from today onwards.
