Heard the parties.
The petitioner has been made accused in connection with Chandwa P.S. Case No. 208 of 2023, corresponding to G.R. Case No.113 of 2024, S.T. Case No.131 of 2024, for the offence registered under Section 364 of the Indian Penal Code and cognizance has been taken under Sections 302, 364 & 201/34 of the Indian Penal Code, pending in the court of Sri Manoj Kumar Singh, learned Sessions Judge, Latehar.
On 19.10.2023, brother-in-law of the informant namely Upendra Singh went missing and after 20-25 days, his dead body was recovered.
From the impugned order, it appears that the deceased had died due to Asphyxia as a result of inhaling coal dust. It also appears that the deceased used to illegally mine coal and sell it in the black market.
Considering the nature of allegation, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Manoj Kumar Singh, learned Sessions Judge, Latehar, in connection with Chandwa P.S. Case No. 208 of 2023, corresponding to G.R. Case No.113 of 2024, S.T. Case No.131 of 2024.
