Tiwari, Spl.P.P. ------ Order No.02 Dated- 27/01/2025 Heard the parties. Apprehending his arrest in connection with Cyber P.S. Case No.136 of 2024 instituted under Sections 78/79/319(2) of the B.N.S., 2023 and Section 66(C)/67(A) of Information Technology Act, the petitioner has moved this Court for grant of privileges of anticipatory bail. Learned counsel appearing for the petitioner submits that the allegation against the petitioner is that the petitioner took the photograph of the daughter of the informant lady from social media platform and got the same edited and made another Fake ID in her name on a social media and shared the same with 70 to 80 friends of the daughter of the informant and demanded money and also distributed the phone number of the daughter of the informant at the price of Rs.1,000/-. It is submitted that the allegation against the petitioner is false. It is next submitted that petitioner has been cooperating with investigation of the case and handed over his mobile phone to the IO of the case which has since been seized. It is next submitted that the petitioner is a practicing Advocate in Hazaribagh and having a very good academic career. It is next submitted that the petitioner is certified Information System Auditor. It is next submitted that this is a case of cyber- crime, the social media account number is no way related to the petitioner but the IP Address of the petitioner was used for the cyber-crime. It is next submitted that the petitioner is not named in the FIR and has got no concern with the informant and her daughter and not even known to the informant, so there is no rhyme and reason why the petitioner will do anything to defame the informant or her daughter. It is also submitted that the petitioner undertakes that the petitioner will not annoy or disturb the informant or any of her family members in any manner during the pendency of the case. It is lastly submitted that the petitioner undertakes to co-operate with the investigation of the case and to furnish sufficient security including cash security. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail. Learned Spl. P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner. Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner. Accordingly, the petitioner is directed to surrender in the Court below within six weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on depositing Rs.1,00,000/- as cash security and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Commissioner-II-cum-Spl. Judge, Cyber Crime, Ranchi in connection with Cyber P.S. Case No.136 of 2024 with the condition that he will co-operate with the investigation of the case and appear before the investigating officer as and when noticed by him and furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number and the petitioner will not annoy or disturb the informant or any of her family members in any manner during the pendency of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
