SG
CRM(A) 2280 of 2025 reject An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with the Complaint Case No.45C of 2025 under Sections 18(a)(i)/174A(f)/18A/18B/22(1)(cca) punishable under Sections 27(b)(i)/27(c)/27(d).28/28A/22(3) read with 36-AC of Drugs and Cosmetics Act, 1940. And In the matter of:
Alok Kumar Mishra … petitioner
Mr. Tanmay Chowdhury
Ms. Ritoprita Ghosh … for the petitioner
Ms. Anasuya Sinha, ld. APP
Mr. Sarthak Mondal … for the State
This is an alleged case of dealing with spurious drugs in the State of the West Bengal as well as in other States. Heard learned counsels for the parties. Perused the case diary. Considering the serious nature of allegations, the fact that there are criminal antecedents available against the petitioner with similar allegations and the fact that there is a money trail shown between the petitioner and other absconding accused, I do not consider this to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail, is thus, rejected.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
